North Dakota came close and ended with nothing: the 2025 ESA that passed both chambers (it would have included homeschool families) was vetoed by the governor as too narrow, and the veto override failed by a handful of votes; the broader ESA he preferred was then killed on the House floor. The legislature has adjourned and doesn’t meet in regular session again until 2027.
One forward-looking note: North Dakota opted into the 2027 federal scholarship tax credit — donation-funded scholarships whose homeschool-expense rules are still being written. Until something real lands, the North Dakota story is doing the well-defined compliance well — and that’s a records problem, which is a solved problem.

An annual statement of intent (form SFN 16909) to your resident district superintendent at least 5 days before beginning — new residents file within 14 days of moving in. It carries proof of the child’s identity, the immunization record, and your qualification (a high school diploma or GED suffices; licensed-teacher monitoring applies only if you have neither, at the district’s expense). Then: at least 4 hours a day across 175 days, the public-school subjects, and an annual record of courses and progress.
Standardized tests in grades 4, 6, 8, and 10, administered by a licensed or approved teacher, with results filed with the superintendent. Exemptions are claimable right on the statement of intent: a philosophical, moral, or religious objection to standardized testing, a teaching license, or a bachelor’s degree. If a composite lands below the 30th percentile, the follow-up is a multidisciplinary assessment and a remediation plan — structured, not punitive.
