Montana’s tax-credit scholarships can’t reach homeschoolers — the statute defining qualified education providers states outright that a provider “is not a home school.” The 2025 attempt at a universal ESA that would have included homeschooling died on third reading, and the legislature doesn’t meet again in regular session until 2027.
The special-needs ESA (HB 393) deserves a status line rather than a sales pitch: it was disability-gated, largely closed to families already homeschooling (its gates favor students leaving public school), and a district court ruled it unconstitutional in December 2025. Under the stay, currently enrolled families can be reimbursed only through June 30, 2026; the Montana Supreme Court declined to lift the stay, and the program’s future is unresolved. Don’t plan around it. Montana did opt into the 2027 federal scholarship credit (January 2026) — homeschool rules still being written.

The old immunization-records and building-code requirements are gone.
